{"id":6469,"date":"2024-10-02T17:54:00","date_gmt":"2024-10-02T12:24:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/bombay-hc-upholds-death-sentence\/"},"modified":"2026-07-21T17:21:20","modified_gmt":"2026-07-21T11:51:20","slug":"bombay-hc-upholds-death-sentence","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/?p=6469","title":{"rendered":"Bombay HC Upholds Death Sentence"},"content":{"rendered":"\n<p style=\"text-align:justify\"><span style=\"font-family:Tahoma,Geneva,sans-serif\"><span style=\"font-size:18px\">Upholding&nbsp; a sentence&nbsp; of the trial court sentencing a man to death in a &lsquo;rarest of rare&rsquo; case the Bombay HC&nbsp; division bench of Justice Revati Mohite Dere and Justice Prithviraj Chavan pronounced their judgment handing capital punishment to a convict who, on August 28<sup>th<\/sup> 2017, killed his mother in what was delineated as a &lsquo;most cruel case&rsquo; by the prosecution.&nbsp;<\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:center\"><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px; text-align:justify\">The case of murder&nbsp; so chilling happened&nbsp; in Kolhapur, on August 28<\/span><sup style=\"text-align:justify\">th<\/sup><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px; text-align:justify\"> 2017, committed by Sunil Rama Kuchkoravi, &nbsp; who&nbsp; killed his mother of 63&nbsp; years for refusing&nbsp; him money to buy liquor as detailed by Additional Public Prosecutor (APP), appearing for the State.&nbsp; The prosecution had twelve eyewitnesses &nbsp;testify to the murder and police on its part investigating the case&nbsp; said&nbsp; they put together &nbsp; forensic evidence and DNA tests of body parts that matched those&nbsp; of the murdered woman. Adducing the &lsquo;condition of the dead body&rsquo; and &lsquo;site of the murder&rsquo;&nbsp; as crucial and clinching evidence the prosecution&nbsp; stated that this was a &lsquo;most cruel&rsquo; case.&nbsp;<\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px\">When trial court Judge, Mahesh Jadhav proclaimed it as a &lsquo;rarest of rare case&rsquo;&nbsp; fit for nothing less than a death sentence in 2021,&nbsp; such an order becomes executable only when the High Court confirms it. The convicted felon, now 38,&nbsp; had not filed an appeal against the conviction and sentence. Hence a confirmation case was filed by the State in 2021, after the sessions court in Kolhapur&nbsp; handed down&nbsp; a&nbsp; sentence of &nbsp; death by hanging&nbsp; to the accused.&nbsp;<\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px\">&nbsp;Ratifying the&nbsp; capital punishment of the trial court&nbsp; stating that there was no flaw in its ruling, &nbsp; the High Court&nbsp; had &nbsp; reserved the appeal&nbsp; and&nbsp; &nbsp; confirmation of case for judgment on August 8<\/span><sup>th<\/sup><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px\">.&nbsp; A reasoned and detailed judgment copy will soon follow&nbsp; stated&nbsp; the Bench&nbsp; no sooner they pronounced their judgment on 1<\/span><sup>st<\/sup><span style=\"font-family:Tahoma,Geneva,sans-serif; font-size:18px\"> October 2024..<\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-family:Tahoma,Geneva,sans-serif\"><span style=\"font-size:18px\">Advocate Yug Choudhary, appeared for the accused.
