Supreme <\/span><span style=\"font-size:16px\">court of<\/span><span style=\"font-size:16px\"> India against the then Chief Minister of Gujarat,<\/span> <span style=\"font-size:16px\">Shri Narendra Modi<\/span><span style=\"font-size:16px\"> was acquitted in a 1997 custodial torture case by the Additional Chief Judicial<\/span> <span style=\"font-size:16px\">Magistrate<\/span><span style=\"font-size:16px\">(ACJM<\/span><span style=\"font-size:16px\">) ,<\/span><span style=\"font-size:16px\">Porbander<\/span><span style=\"font-size:16px\"> District court, Gujarat<\/span><span style=\"font-size:16px\">,<\/span><span style=\"font-size:16px\"> on grounds that the prosecution failed to <\/span><span style=\"font-size:16px\">&lsquo;<\/span><span style=\"font-size:16px\">prove the case beyond reasonable doubt<\/span><span style=\"font-size:16px\">&rsquo;<\/span><span style=\"font-size:16px\">.<\/span> <span style=\"font-size:16px\">The <\/span><span style=\"font-size:16px\">officer <\/span><span style=\"font-size:16px\">is<\/span><span style=\"font-size:16px\"> currently in Rajkot Jail <\/span><span style=\"font-size:16px\">serving a<\/span><span style=\"font-size:16px\"> life sentence in <\/span><span style=\"font-size:16px\">a 1997&nbsp;<\/span><span style=\"font-size:16px\">case of custodial<\/span><span style=\"font-size:16px\"> death and a <\/span><span style=\"font-size:16px\">20-year<\/span><span style=\"font-size:16px\"> jail term in a 1996 case relating to planting drugs to implicate a Rajasthan based lawyer in <\/span><span style=\"font-size:16px\">Palanpur<\/span><span style=\"font-size:16px\">. <\/span><span style=\"font-size:16px\">He currently <\/span><span style=\"font-size:16px\">stands acquitted<\/span> <span style=\"font-size:16px\">of the<\/span><span style=\"font-size:16px\"> custodial deat<\/span><span style=\"font-size:16px\">h case of 1997 by <\/span><span style=\"font-size:16px\">the ACJM<\/span><span style=\"font-size:16px\">.<\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:center\"><span style=\"font-family:Georgia,serif\"><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">Bhatt is <\/span><span style=\"font-size:16px\">being held <\/span><span style=\"font-size:16px\">in offences<\/span><span style=\"font-size:16px\"> under several sections<\/span><span style=\"font-size:16px\">. <\/span><span style=\"font-size:16px\">In the<\/span><span style=\"font-size:16px\"> year <\/span><span style=\"font-size:16px\">2002 a<\/span> <span style=\"font-size:16px\">FIR was <\/span><span style=\"font-size:16px\">registered against<\/span><span style=\"font-size:16px\"> him,<\/span><span style=\"font-size:16px\"> for <\/span><span style=\"font-size:16px\">alleged fabrication of <\/span><span style=\"font-size:16px\">evidence in<\/span><span style=\"font-size:16px\"> the <\/span><span style=\"font-size:16px\">Gujarat <\/span><span style=\"font-size:16px\">communal riots<\/span><span style=\"font-size:16px\"> case along <\/span><span style=\"font-size:16px\">with activist&nbsp;<\/span><span style=\"font-size:16px\">Teesta Setalvad and <\/span><span style=\"font-size:16px\">former Gujarat Director General of Police <\/span><span style=\"font-size:16px\">R B Sreekumar<\/span><span style=\"font-size:16px\">.<\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">Bhatt, a Gujarat- cadre police officer <\/span><span style=\"font-size:16px\">who <\/span><span style=\"font-size:16px\">had served as Superintendent of Police (SP) <\/span><span style=\"font-size:16px\">was also <\/span><span style=\"font-size:16px\">charged for<\/span> <span style=\"font-size:16px\"> offences under <\/span><span style=\"font-size:16px\">section 326 (voluntarily causing <\/span><span style=\"font-size:16px\">grievous hurt by dangerous weapons or means), 330 (voluntarily causing hurt to extort confession, or to compel restoration of property) and 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code (IPC)<\/span><span style=\"font-size:16px\">.<\/span> <\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">Also facing charges<\/span><span style=\"font-size:16px\"> on a complaint <\/span><span style=\"font-size:16px\">by one Naran Jadhav<\/span><span style=\"font-size:16px\">, <\/span><span style=\"font-size:16px\">the officer <\/span><span style=\"font-size:16px\">,<\/span><span style=\"font-size:16px\"> in that case <\/span><span style=\"font-size:16px\">was accused of <\/span><span style=\"font-size:16px\">physical and mental torture<\/span><span style=\"font-size:16px\"> of the complainant <\/span><span style=\"font-size:16px\">while he was in police custody <\/span><span style=\"font-size:16px\">in order to extract a confession in a Terrorist and Disruptive Activities <\/span><span style=\"font-size:16px\">(Prevention) Act (TADA) and Arm<\/span><span style=\"font-size:16px\">s<\/span><span style=\"font-size:16px\"> Act<\/span><span style=\"font-size:16px\">. <\/span><span style=\"font-size:16px\">For the alleged offences he was <\/span><span style=\"font-size:16px\">charged <\/span><span style=\"font-size:16px\">under section<\/span><span style=\"font-size:16px\">s 330(causing hurt to extort confession)and <\/span><span style=\"font-size:16px\">324<\/span> <span style=\"font-size:16px\">(causing hurt with dangerous weapons)<\/span><span style=\"font-size:16px\"> of IPC<\/span><span style=\"font-size:16px\">. <\/span><span style=\"font-size:16px\">Out of the 22 accused <\/span><span style=\"font-size:16px\">in the 1994 arms recovery case, Jadhav was one among them.<\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">It was the prosecution&rsquo;s case that <\/span><span style=\"font-size:16px\">on July<\/span><span style=\"font-size:16px\"> 5<\/span><span style=\"font-size:10px\">th<\/span><span style=\"font-size:16px\"> ,1997<\/span><span style=\"font-size:16px\">,<\/span> <span style=\"font-size:16px\">by way of a transfer warrant<\/span> <span style=\"font-size:16px\">Jadhav was <\/span><span style=\"font-size:16px\">transferred by a police team <\/span><span style=\"font-size:16px\">from Ahmedabad&rsquo;s Sabarmati Central Jail<\/span><span style=\"font-size:16px\"> to Bhatt&rsquo;s house in Porbandar in Gujarat<\/span><span style=\"font-size:16px\"> and <\/span><span style=\"font-size:16px\">Jadhav claimed that he <\/span><span style=\"font-size:16px\">was <\/span><span style=\"font-size:16px\">put through torture <\/span><span style=\"font-size:16px\">by electric shocks in that period. <\/span><span style=\"font-size:16px\">He lodged a formal complaint <\/span><span style=\"font-size:16px\">before a judicial Magistrate <\/span><span style=\"font-size:16px\">against this torture carried out under the inst<\/span><span style=\"font-size:16px\">r<\/span><span style=\"font-size:16px\">uctions from Bhatt<\/span><span style=\"font-size:16px\">. An <\/span><span style=\"font-size:16px\">e<\/span><span style=\"font-size:16px\">nquiry was ordered<\/span><span style=\"font-size:16px\"> and based on evidence a case <\/span><span style=\"font-size:16px\">was registered against him in 1998, summons were issued <\/span><span style=\"font-size:16px\">to Bhatt and another police constable <\/span><span style=\"font-size:16px\">, Chau. <\/span><span style=\"font-size:16px\">A FIR was lodged against them <\/span><span style=\"font-size:16px\">but <\/span><span style=\"font-size:16px\">upon <\/span><span style=\"font-size:16px\">the death of Chau the <\/span><span style=\"font-size:16px\">case abated.<\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">A sessions court in Jamnagar had held him guilty<\/span><span style=\"font-size:16px\"> in March this year <\/span><span style=\"font-size:16px\"> for causing the death of a detainee, who along with many others, was held in police custody during the communal riots that rocked Gujarat in the year 1989. Besides, he is also serving <\/span><span style=\"font-size:16px\">a 20-year sentence <\/span><span style=\"font-size:16px\">in a case of planting drugs <\/span><span style=\"font-size:16px\">after a sessions court <\/span><span style=\"font-size:16px\">in <\/span><span style=\"font-size:16px\">Banaskantha<\/span><span style=\"font-size:16px\"> district of Gujarat <\/span><span style=\"font-size:16px\">charged him under <\/span><span style=\"font-size:16px\">provisions of the Narcotics Drugs and Psychotropic <\/span><span style=\"font-size:16px\">Substances (NDPS)Act and the India<\/span><span style=\"font-size:16px\">n Penal Code<\/span><span style=\"font-size:16px\">(IPC).<\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif; font-size:16px\">Stating that the prosecution failed to &lsquo;prove the case beyond doubt&rsquo;<\/span><span style=\"font-family:Georgia,serif; font-size:16px\">the court observed that <\/span><span style=\"font-family:Georgia,serif; font-size:16px\">the officer<\/span><span style=\"font-family:Georgia,serif; font-size:16px\">,<\/span><span style=\"font-family:Georgia,serif; font-size:16px\"> was <\/span><span style=\"font-family:Georgia,serif; font-size:16px\">a public servant performing his duties at that time and therefore the required mandatory sanction to prosecute him was also not obtained. <\/span><span style=\"font-family:Georgia,serif; font-size:16px\">The court also observed that the complainant in the case was coerced into confessing to the crime and was forced to surrender by way of threats and the use of dangerous weapons.<\/span><\/p>\n \n \n \n <hr \/>\n \n <p><span style=\"font-family:Georgia,serif\"><span style=\"font-size:18px\"><span style=\"font-size:16px\">Advocate for the <\/span><span style=\"font-size:16px\">Petitioner: A.P.P.
