Former Indian Police <\/span>Service (<\/span>IPS) officer, Sanjiv Bhatt,<\/span> who had filed an affidavit in the Supreme <\/span>court of<\/span> India against the then Chief Minister of Gujarat,<\/span> Shri Narendra Modi<\/span> was acquitted in a 1997 custodial torture case by the Additional Chief Judicial<\/span> Magistrate<\/span>(ACJM<\/span>) ,<\/span>Porbander<\/span> District court, Gujarat<\/span>,<\/span> on grounds that the prosecution failed to <\/span>‘<\/span>prove the case beyond reasonable doubt<\/span>’<\/span>.<\/span> The <\/span>officer <\/span>is<\/span> currently in Rajkot Jail <\/span>serving a<\/span> life sentence in <\/span>a 1997 <\/span>case of custodial<\/span> death and a <\/span>20-year<\/span> jail term in a 1996 case relating to planting drugs to implicate a Rajasthan based lawyer in <\/span>Palanpur<\/span>. <\/span>He currently <\/span>stands acquitted<\/span> of the<\/span> custodial deat<\/span>h case of 1997 by <\/span>the ACJM<\/span>.<\/span><\/span><\/span><\/p>\n \n \n \n

<\/span><\/p>\n \n \n \n

Bhatt is <\/span>being held <\/span>in offences<\/span> under several sections<\/span>. <\/span>In the<\/span> year <\/span>2002 a<\/span> FIR was <\/span>registered against<\/span> him,<\/span> for <\/span>alleged fabrication of <\/span>evidence in<\/span> the <\/span>Gujarat <\/span>communal riots<\/span> case along <\/span>with activist <\/span>Teesta Setalvad and <\/span>former Gujarat Director General of Police <\/span>R B Sreekumar<\/span>.<\/span><\/span><\/span><\/p>\n \n \n \n

Bhatt, a Gujarat- cadre police officer <\/span>who <\/span>had served as Superintendent of Police (SP) <\/span>was also <\/span>charged for<\/span> offences under <\/span>section 326 (voluntarily causing <\/span>grievous hurt by dangerous weapons or means), 330 (voluntarily causing hurt to extort confession, or to compel restoration of property) and 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code (IPC)<\/span>.<\/span> <\/span><\/span><\/p>\n \n \n \n

Also facing charges<\/span> on a complaint <\/span>by one Naran Jadhav<\/span>, <\/span>the officer <\/span>,<\/span> in that case <\/span>was accused of <\/span>physical and mental torture<\/span> of the complainant <\/span>while he was in police custody <\/span>in order to extract a confession in a Terrorist and Disruptive Activities <\/span>(Prevention) Act (TADA) and Arm<\/span>s<\/span> Act<\/span>. <\/span>For the alleged offences he was <\/span>charged <\/span>under section<\/span>s 330(causing hurt to extort confession)and <\/span>324<\/span> (causing hurt with dangerous weapons)<\/span> of IPC<\/span>. <\/span>Out of the 22 accused <\/span>in the 1994 arms recovery case, Jadhav was one among them.<\/span><\/span><\/span><\/p>\n \n \n \n

It was the prosecution’s case that <\/span>on July<\/span> 5<\/span>th<\/span> ,1997<\/span>,<\/span> by way of a transfer warrant<\/span> Jadhav was <\/span>transferred by a police team <\/span>from Ahmedabad’s Sabarmati Central Jail<\/span> to Bhatt’s house in Porbandar in Gujarat<\/span> and <\/span>Jadhav claimed that he <\/span>was <\/span>put through torture <\/span>by electric shocks in that period. <\/span>He lodged a formal complaint <\/span>before a judicial Magistrate <\/span>against this torture carried out under the inst<\/span>r<\/span>uctions from Bhatt<\/span>. An <\/span>e<\/span>nquiry was ordered<\/span> and based on evidence a case <\/span>was registered against him in 1998, summons were issued <\/span>to Bhatt and another police constable <\/span>, Chau. <\/span>A FIR was lodged against them <\/span>but <\/span>upon <\/span>the death of Chau the <\/span>case abated.<\/span><\/span><\/span><\/p>\n \n \n \n

A sessions court in Jamnagar had held him guilty<\/span> in March this year <\/span> for causing the death of a detainee, who along with many others, was held in police custody during the communal riots that rocked Gujarat in the year 1989. Besides, he is also serving <\/span>a 20-year sentence <\/span>in a case of planting drugs <\/span>after a sessions court <\/span>in <\/span>Banaskantha<\/span> district of Gujarat <\/span>charged him under <\/span>provisions of the Narcotics Drugs and Psychotropic <\/span>Substances (NDPS)Act and the India<\/span>n Penal Code<\/span>(IPC).<\/span><\/span><\/span><\/p>\n \n \n \n

Stating that the prosecution failed to ‘prove the case beyond doubt’<\/span>the court observed that <\/span>the officer<\/span>,<\/span> was <\/span>a public servant performing his duties at that time and therefore the required mandatory sanction to prosecute him was also not obtained. <\/span>The court also observed that the complainant in the case was coerced into confessing to the crime and was forced to surrender by way of threats and the use of dangerous weapons.<\/span><\/p>\n \n \n \n
