{"id":6659,"date":"2025-03-07T12:32:00","date_gmt":"2025-03-07T07:02:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/collegium-controversy-seniority-sidestepped-in-sca-appointment\/"},"modified":"2026-07-21T17:17:27","modified_gmt":"2026-07-21T11:47:27","slug":"collegium-controversy-seniority-sidestepped-in-sca-appointment","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/collegium-controversy-seniority-sidestepped-in-sca-appointment\/","title":{"rendered":"Collegium Controversy: Seniority Sidestepped in SC\u00c2 Appointment"},"content":{"rendered":"\n<address>The Supreme Court Collegium has once again stirred debate with its latest recommendation&mdash;elevating Justice Joymalya Bagchi of the Calcutta High Court to the Supreme Court.<\/address>\n \n \n \n <address style=\"text-align: center;\"><\/address>\n \n \n \n <p>While Justice Bagchi&#39;s competence and integrity are not in question, his selection over ten senior judges, including eight Chief Justices, has reignited concerns over the Collegium&rsquo;s appointment process.<\/p>\n \n \n \n <p>Justice Bagchi ranks 11th in all-India seniority among High Court judges, yet the Collegium chose to overlook several more senior candidates.&nbsp;<\/p>\n \n \n \n <p>Notably, four senior judges from his own parent High Court<strong>&mdash;Justice Biswanath Somadder, Justice Indra Prasanna Mukerji, Justice Harish Tandon, and Justice Soumen Sen&mdash;<\/strong>were bypassed.&nbsp;<\/p>\n \n \n \n <p>Some of them are already serving as Chief Justices of other High Courts, a position traditionally seen as a stepping stone to the Supreme Court.&nbsp;<\/p>\n \n \n \n <p>The Collegium cited a lack of representation from the Calcutta High Court, despite senior judges from the same High Court being available for elevation.&nbsp;<\/p>\n \n \n \n <p>At present, only one Supreme Court judge, Justice Dipankar Datta, hails from the Calcutta High Court.<\/p>\n \n \n \n <p>While the Collegium claims to evaluate &ldquo;<strong><em>merit, integrity, and competence,<\/em><\/strong>&rdquo; its latest decision shows the opaque nature of judicial appointments.&nbsp;<\/p>\n \n \n \n <p>The exclusion of senior judges without a clear explanation only adds to the perception that Supreme Court elevations are driven by factors beyond judicial experience.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court Collegium has once again stirred debate with its latest recommendation&mdash;elevating Justice Joymalya Bagchi of the Calcutta High Court to the Supreme Court.
