{"id":6881,"date":"2025-02-09T09:42:00","date_gmt":"2025-02-09T04:12:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/plea-to-install-loudspeaker-in-masjid-dismissed-allahabad-hc\/"},"modified":"2026-07-21T17:23:40","modified_gmt":"2026-07-21T11:53:40","slug":"plea-to-install-loudspeaker-in-masjid-dismissed-allahabad-hc","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/plea-to-install-loudspeaker-in-masjid-dismissed-allahabad-hc\/","title":{"rendered":"Plea To Install Loudspeaker In Masjid Dismissed: Allahabad HC"},"content":{"rendered":"\n<p><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">In its recent judgment, the Allahabad High Court<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> dismissed the plea of<\/strong><\/span> petitioner, Muktiyar Ahmed,<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> who pleaded for permission to install loudspeakers in a Masjid.<\/strong><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:center\"><\/p>\n \n \n \n <p><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">Dismissing the plea the bench of<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> Justice Ashwani Kumar<\/strong><\/span> and<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> Justice Donadi Ramesh<\/strong><\/span>, noted that the Writ petition is not maintainable since the petitioner does not have locus for filing the Petition as he was neither a mutwalli nor does he possess ownership of the mosque. The High Court further stated that<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> &ldquo;religious places are for offering prayer to the divinity, and the use of loudspeakers cannot be claimed as a matter of right as it creates nuisance for other residents as well.&rdquo;<\/strong><\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">A similar verdict in regards to the installation of loudspeakers was also held by the<span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> Bombay High Court<\/strong><\/span> in the case of <a href=\"https:\/\/indiankanoon.org\/doc\/72134394\/\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong><span style=\"color:#1155cc\">Jaago Nehru Nagar Residents Welfare Association vs Comissioner of Police (2025),<\/span><\/strong><\/span><\/a> where it was held that <span style=\"font-family:TimesNewRomanPS-BoldItalicMT\"><strong><em>&ldquo;Noise is a major health hazard on various aspects. No one can claim that his rights are affected in any manner if he is denied a permission to use of loudspeaker. It is in public interest that such permissions should not be granted. By denying such permissions, rights under Article 19 or 25 of the Constitution of India are not at all infringed. Use of loudspeakers is not an essential part of any religion.&quot;<\/em><\/strong><\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">In May 2020, the Allahabad High Court, in the case of<a href=\"https:\/\/elegalix.allahabadhighcourt.in\/elegalix\/WebDownloadJudgmentDocument.do\"> <span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong><span style=\"color:#1155cc\">Afzal Ansari &amp; Ors vs State of UP &amp;Ors<\/span><\/strong><\/span><\/a><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>,<\/strong><\/span> <span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> ruled that the usage of loudspeakers in mosques is not a fundamental right. <\/strong><\/span>The court made strict observations about the usage of loudspeakers in mosques.
