Pardiwala <\/strong><\/span>and <span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>JusticeR. Mahadevan <\/strong><\/span>heard a petition challenging the fees and incidental charges imposed for the All India Bar Examination (AIBE). The petition was filed by an Advocate appearing in person, who argued that the <span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>Bar Council of India (BCI) charges Rs.3,500 for the AIBE<\/strong><\/span> which violates the Supreme Court&#39;s ruling in <span style=\"font-family:TimesNewRomanPS-BoldItalicMT\"><strong><em><span style=\"color:#1155cc\"><a href=\"https:\/\/indiankanoon.org\/doc\/46300019\/\">Gaurav Kumar v. Union of India (2024).<\/a><\/span><\/em><\/strong><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:center\"><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-family:TimesNewRomanPS-BoldItalicMT\"><strong><em><\/em><\/strong><\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">The petitioner argued that, according to the Gaurav Kumar judgment delivered by a three-judge bench comprising former <span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>CJI D.Y. Chandrachud and Justice J.B. Pardiwala and Justice Manoj Misra, <\/strong><\/span>the enrollment fee should be capped at \u00e2\u201a\u00b9750 for general category advocates and \u00e2\u201a\u00b9125 for SC\/ST advocates, as prescribed under Section 24 of the Advocates Act, 1961.<\/span><\/span><\/p>\n \n \n \n <p style=\"margin-left:0px; margin-right:0px\"><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">The bench directed the petitioner to first approach the Bar Council of India (BCI) with a representation. If the BCI failed to respond within a reasonable time, he could seek relief from the Court. Justice Pardiwala remarked that the BCI needed funds to sustain itself, especially after its powers had been significantly curtailed. He also questioned the objection to the \u00e2\u201a\u00b93,500 fee, emphasizing that lawyers would eventually earn much more.<\/span><\/span><\/p>\n \n \n \n <p style=\"margin-left:0px; margin-right:0px\"><span style=\"font-size:16px\"><span style=\"font-family:&quot;Times New Roman&quot;\">The Court also questioned the petitioner&rsquo;s decision to invoke Article 32 jurisdiction instead of approaching a High Court.
