{"id":7018,"date":"2025-04-08T09:06:00","date_gmt":"2025-04-08T03:36:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/tn-governor-rapped-by-sc-for-road-blocking-bills\/"},"modified":"2026-07-21T17:28:17","modified_gmt":"2026-07-21T11:58:17","slug":"tn-governor-rapped-by-sc-for-road-blocking-bills","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/?p=7018","title":{"rendered":"TN Governor Rapped By SC For Road Blocking Bills"},"content":{"rendered":"\n<p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">In a possibly unprecedented decision, the Supreme Court, a while ago, rapped the Governor of Tamil Nadu, RN Ravi, observing <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>that a Governor does not possess the authority to indefinitely withhold bills sent by a state legislature.<\/strong><\/span><\/span><span style=\"font-size:18.67px\"> The bench of<\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong> Justice JB Pardiwala and Justice R Mahadevan <\/strong><\/span><\/span><span style=\"font-size:18.67px\">reprehended the handling of 10 bills that would be, <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:'TimesNewRomanPS-BoldItalicMT'\"><strong><em>&ldquo;deemed to have been cleared from the date they were presented again to the Governor after reconsideration by the legislature.&rdquo;<\/em><\/strong><\/span><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:center\"><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">The Court made it clear that once a bill is re-submitted after reconsideration by the assembly, the Governor is constitutionally required to grant assent. <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>The Governor can refuse assent only if the bill is different from its previous form.<\/strong><\/span><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">The bench stated:<\/span><br \/>\n \n <span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>&quot;Action of Governor to reserve the 10 bills for President is illegal and arbitrary and thus the action is set aside. All actions taken by Governor thereto for the 10 bills is set aside. The 10 bills shall be deemed to be clear from the date it was re-presented to the Governor.&quot;<\/strong><\/span><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">This judgment came in response to a petition filed by the Tamil Nadu government challenging the Governor&rsquo;s delay and refusal in approving multiple bills passed by the legislative assembly.<\/span><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:&quot;Times New Roman&quot;; font-size:18.67px; text-align:justify\">Addressing the Governor&#39;s prolonged inaction, the Court noted:<\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>&ldquo;There is no expressly specified time limit for the discharge of the functions by the Governor under Article 200 of the Constitution. Despite there being no prescribed time limits, Article 200 cannot be read in a manner which allows the Governor to not take action upon this, which are presented to him for assent and thereby delay, and essentially roadblock law making machinery in the State&#8230;Whenever a bill is presented to the Governor, he is under a constitutional obligation to adopt one of the three courses of action available.&quot;<\/strong><\/span><\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">In a significant step, the Court introduced clear timelines within which Governors must act on bills passed by the legislature. It also clarified that non-compliance with these timelines could bring the Governor&rsquo;s inaction under judicial review.<\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">The timelines outlined are:<\/span><\/span><\/span><\/p>\n \n \n \n <ol>\n \n <li style=\"text-align:justify\"><span style=\"font-size:18.67px\">If the Governor withholds assent and reserves the bill for the President <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>with<\/strong><\/span><\/span><span style=\"font-size:18.67px\"> the aid and advice of the Council of Ministers: <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>maximum of one month<\/strong><\/span><\/span><\/li>\n \n <li style=\"text-align:justify\"><span style=\"font-size:18.67px\">If the Governor withholds assent <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>without<\/strong><\/span><\/span><span style=\"font-size:18.67px\"> such aid and advice: <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>bill must be returned within three months<\/strong><\/span><\/span><\/li>\n \n <li style=\"text-align:justify\"><span style=\"font-size:18.67px\">If the bill is re-presented after reconsideration by the legislature: <\/span><span style=\"font-size:18.67px\"><span style=\"font-family:TimesNewRomanPS-BoldMT\"><strong>Governor must give assent within one month<\/strong><\/span><\/span><\/li>\n \n <\/ol>\n \n \n \n <p style=\"margin-left:0px; margin-right:0px; text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">The State government had approached the Supreme Court seeking directions to ensure that the Governor or President act on bills within a fixed timeframe. It argued that the Governor&rsquo;s indefinite delay was paralyzing governance, hence judicial intervention was necessary.<\/span><\/span><\/span><\/p>\n \n \n \n <p style=\"margin-left:0px; margin-right:0px; text-align:justify\"><span style=\"font-size:18.7px\"><span style=\"font-family:&quot;Times New Roman&quot;\"><span style=\"font-size:18.67px\">On February 11, the Court had asked the Governor how he could refer a bill to the President after it had already been reconsidered and passed again by the legislature.
