{"id":7134,"date":"2025-07-23T08:48:00","date_gmt":"2025-07-23T03:18:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/uber-rides-rescued-hc-derails-protest\/"},"modified":"2026-07-21T17:30:48","modified_gmt":"2026-07-21T12:00:48","slug":"uber-rides-rescued-hc-derails-protest","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/?p=7134","title":{"rendered":"Uber Rides Rescued : HC Derails Protest"},"content":{"rendered":"\n<p dir=\"ltr\"><span style=\"font-size:16pt\"><span style=\"font-size:16px\">The popular app-based cab aggregator, &lsquo;Uber&rsquo; got a major reprieve from the Bombay High Court, which has extended <\/span><\/span><span style=\"font-size:16px\"><strong>urgent ex parte ad i<\/strong><\/span><span style=\"font-size:16px\"><strong>nterim relief<\/strong> to them, effectively shielding the company from an imminent protest organized by rickshaw drivers&rsquo; unions, which was slated to commence from <strong>July 23<\/strong><\/span><span style=\"font-size:16pt\">.<\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:center\"><span style=\"font-size:16pt\"><\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">The relief was granted after Uber approached the Court seeking protection due to <strong>threats of violence and disruptions<\/strong> to its operations and services.<\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">The matter was heard by <strong>Justice R.I. Chagla<\/strong><\/span><span style=\"font-size:16pt\"><span style=\"font-size:16px\">, who presided over the single-judge bench. Uber, represented by its legal counsel, submitted that the<\/span> <span style=\"font-size:16px\">protests had escalated beyond mere dissent and were now actively <\/span><\/span><span style=\"font-size:16px\"><strong>targeting their driver-partners<\/strong>.<\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">The unions were allegedly <strong>instigating Uber drivers<\/strong> to abandon services and demanding <strong>parity with black and yellow taxis<\/strong>, in addition to a <\/span><span style=\"font-size:16pt\"><strong><span style=\"font-size:16px\">ban on bike<\/span> <span style=\"font-size:16px\">taxis<\/span><\/strong><\/span><span style=\"font-size:16px\">.<\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">Uber&rsquo;s counsel told the Court that the agitation had taken a violent turn. Their submissions detailed instances where <strong>Uber drivers were being threatened<\/strong>, forcibly stopped mid-ride, and subjected to <strong>physical violence<\/strong><\/span><span style=\"font-size:16pt\"><span style=\"font-size:16px\">, including<\/span> <\/span><span style=\"font-size:16px\"><strong>vandalism of vehicles<\/strong>.<\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">The situation had deteriorated to such an extent that <strong>police complaints had been lodged not only by Uber but also by its drivers and passengers<\/strong>. Even though authorities had issued warnings to avoid disruptions, the counsel argued, the situation <strong>escalated<\/strong> further &mdash; including <strong>chasing Uber drivers at the Mumbai airport<\/strong> and <strong>smashing car windshields<\/strong>.<\/span><\/p>\n \n \n \n <p><span style=\"font-size:16px\">Uber further contended that <strong>pamphlets<\/strong> were being circulated by union leaders, <strong>provoking driver-partners to participate<\/strong> in the unlawful protest.<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">To support its plea for interim protection, the company submitted documentation showing <strong>similar incidents in Delhi, Bengaluru, and Hyderabad<\/strong>, where courts had previously granted <strong>protective relief<\/strong>, and urged the Bombay High Court to issue <strong>similar directions<\/strong>, including <strong>police assistance<\/strong>.<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">The Court took serious note of the submissions and observed that the <strong>plaintiff&rsquo;s services were being hampered<\/strong>, and more critically, <strong>threats were being posed to both Uber drivers and passengers<\/strong>.<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">Additionally, the court remarked that if notice had been served to the defendants beforehand, it could have <strong>&quot;escalated the situation&quot;<\/strong> even further, hence necessitating ex parte relief. <\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">Justice Chagla also referred to a <strong>notice issued by the rickshaw driver unions<\/strong> to their members, which explicitly <strong>called for the disruption of Ola and Uber&rsquo;s services<\/strong>. <\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">What heightened the urgency of the matter, the Court noted, was that the unions had declared that <strong>starting July 23, all Uber vehicles would not only be halted but also damaged<\/strong>.<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\">After considering the submissions, the Court concluded:<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:16px\"><em>&ldquo;Having gone through the submissions I believe that the plaintiffs have made out a strong case for ex parte ad interim relief. Given the last actions of the defendants, the protest slated from today would not be peaceful.
