It was also argued that while co-accused have been granted bail, parity was denied in this instance.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>Background<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">:<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">The allegations pertain to a conspiracy allegedly orchestrated by Myanmar-based terror outfits to &ldquo;wage war&rdquo; against the Government of India, exploiting the ethnic unrest in Manipur. The accused is said to be a senior member of the <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>banned People&rsquo;s Liberation Army<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"> under the <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>Unlawful Activities (Prevention) Act, 1967,<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">(<\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>UAPA)<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">, with a past record of arrest under the <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>Kangleipak Communist Party (KCP)<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"> case. KCP is a banned militant organization in Manipur.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">The accused was allegedly apprehended in September 2023, with weapons identified as looted from state armouries and has been linked to training activities for the Revolutionary People&rsquo;s Front (RPF) which is a proscribed militant group in northeastern India that seeks to establish an independent state of Manipur. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">Initially booked by Manipur Police under a combination of <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>IPC<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">, <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>Arms Act<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">, <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>UAPA<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"> and the <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>Official Secrets Act<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">, the matter was later taken over by the <\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>National Investigation Agency (<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">NIA<\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\"><strong>),<\/strong><\/span><\/span><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">which registered its own case under corresponding provisions.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">Bail granted in the Manipur FIR was followed by immediate re-arrest under the NIA case, resulting in continued custody. Earlier, the Special Court and subsequently the Delhi High Court refused bail, noting the seriousness of the allegations. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:justify\"><span style=\"font-size:16pt\"><span style=\"font-family:Georgia,serif\">The Supreme Court&rsquo;s present intervention however, limited to seeking the NIA&rsquo;s response on trial status.
