Kotiswar Singh<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> of the Supreme Court delivered an important ruling on <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>December 1, 2025<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">. The Court <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>set aside the convictions of three people in a murder case<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> after finding major procedural mistakes in how their statements were recorded under <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Section 313 of the Criminal Procedure Code (CrPC)<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:center\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Supreme Court stressed that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>public prosecutors have a duty that goes beyond trying to secure convictions<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">. They must assist the trial court conscientiously,<\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong> rather<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> than acting solely as the State&rsquo;s advocate for conviction.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Background:<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">In this case, the Court found that the accused were <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>not properly questioned<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> during their Section 313 examinations. They were confronted with the allegations only in a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>superficial<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> manner. Their answers were <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>generic, mechanical, and almost identical<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, which showed that they had not been asked about <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>each important piece of evidence<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> separately, as required.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Court held that this was a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>serious violation of fair trial rights<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">. Because of this defect, it <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>set aside the convictions and sentences<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, and ordered that the case be sent back for a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>fresh trial<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, starting again from the stage of recording the <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Section 313 statements<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The bench critically highlighted that the prosecution has an important responsibility during a trial. It said that the <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>public prosecutor<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> must make sure that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>no procedural mistake harms the accused<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, and must <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>help the trial court<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> by ensuring that all the <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>correct and relevant questions<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> are put to the accused during their Section 313 examination.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">&ldquo;It is equally disturbing for us to see that in the desire to secure a conviction for the accused persons, the prosecutor also let their duty of assisting the Court in conducting the examination of the accused under this section fall by the wayside. The prosecutor is an officer of the Court and holds a solemn duty to act in the interest of justice. They cannot act as a defence lawyer, but for the State, with the sole aim of making the gauntlet of punishment fall on the accused,&rdquo; the Court stated, quoting the reference of <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Sovaran Singh Prajapati v. State of U.P.<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The judgment also reiterated that a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>fair trial<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> means the accused must get a complete chance to respond to every allegation,whether through their lawyer, by calling witnesses, or by personally answering the charges under Section 313 CrPC. The Court stressed that this is a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>&ldquo;non-negotiable requirement of a fair trial.&rdquo;<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Court further said that the <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>prosecution must actively inform the court<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> if anything is missed during the accused&rsquo;s Section 313 examination so that no unfair mistakes occur.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">This view is consistent with the Supreme Court&rsquo;s earlier decision in <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Ashok v. State of Uttar Pradesh (2024)<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, where the Court had similarly said that the <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Public Prosecutor must help the court in properly recording the accused&rsquo;s statement and ensure that no material circumstance is left out<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> during questioning.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Ultimately, the Court set aside the sentences due to non-compliance with Section 313 CrPC and ordered the trial court to commence fresh proceedings at the examination stage. <\/span><\/span><\/p>\n \n \n \n <hr \/>\n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Case Detail: <\/span><\/span><a href=\"https:\/\/api.sci.gov.in\/supremecourt\/2025\/1537\/1537_2025_9_1501_66422_Judgement_01-Dec-2025.pdf\" style=\"text-decoration-line:none\"><span style=\"font-size:13pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#1155cc\">CHANDAN PASI &amp; ORS.
