{"id":7365,"date":"2025-11-26T07:26:00","date_gmt":"2025-11-26T01:56:00","guid":{"rendered":"https:\/\/lawfultalks3.selfst.art\/nationwide-cctv-failure-sc-summons-top-officials-calls-custodial-deaths-blot-on-the-system\/"},"modified":"2026-07-21T17:50:01","modified_gmt":"2026-07-21T12:20:01","slug":"nationwide-cctv-failure-sc-summons-top-officials-calls-custodial-deaths-blot-on-the-system","status":"publish","type":"post","link":"https:\/\/lawfultalks3.selfst.art\/?p=7365","title":{"rendered":"Nationwide CCTV Failure: SC Summons Top Officials, Calls Custodial Deaths \u2018Blot On The System\u2019."},"content":{"rendered":"\n<p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Supreme Court has sharply criticised the Union Government and several State Governments for failing to comply with its 2020 order directing the installation of functional CCTV cameras&mdash;with night-vision capability and audio recording&mdash;in all police stations and offices of central investigating agencies.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:center\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Background:<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">A Bench of Justice Vikram Nath and Justice Sandeep Mehta was hearing a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><em>suo motu<\/em><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> matter triggered by a report showing <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>11 custodial deaths in Rajasthan in just eight months,<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> even though the Supreme Court had already issued <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>binding directions to install functional CCTV cameras<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> in all police stations. Despite these directions, the cameras were still not installed.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The judges called custodial deaths a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>&ldquo;blot on the system&rdquo; <\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">and remarked that the Union government appeared to be taking the Court &ldquo;<\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>too lightly&rdquo;<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, noting that it had not even filed a proper compliance affidavit. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Justice Mehta recalled that all States and Union Territories had earlier been ordered to file compliance affidavits, but many had failed to do so. Amicus Curiae, Senior Advocate Siddhartha Dave, informed the Court that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>only 11 States<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> had complied so far. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Justice Mehta praised Madhya Pradesh as a &ldquo;model State&rdquo; for its CCTV implementation- a characterisation that Amicus Curiae Siddhartha Dave agreed with. <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><em>&ldquo;<\/em><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong><em>Madhya Pradesh&rsquo;s work is remarkable,&rdquo;<\/em><\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> Justice Mehta observed.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Bench then questioned why other States had remained silent. It expressed particular surprise that Kerala, known for its administrative efficiency, had not filed its report, asking: <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>&ldquo;Why is Kerala shying away? It&rsquo;s such an advanced state.&rdquo;<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Dave also noted that even the Union had <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>not<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> filed its compliance affidavit. This led Justice Nath to ask,<\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>&ldquo;The Union is taking the Court very lightly. Why?&rdquo;<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> Justice Mehta stressed the gravity of the situation, saying, <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>&ldquo;Not affidavit, compliance. There were 11 deaths in police stations in 8 months in Rajasthan. Custodial deaths. This will not be tolerated by the country. It is a blot on the system.&rdquo;<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">During the hearing, the Bench also discussed prison reforms. Justice Mehta observed that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>open-air jails<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> could help ease overcrowding and support rehabilitation, while Justice Nath added that such measures would also reduce the State&rsquo;s financial burden.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Solicitor General Tushar Mehta, appearing for the Union, undertook to file the required affidavit and sought<\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong> three weeks&rsquo; time <\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">to ensure that all States and Union Territories submit their compliance affidavits. The Court granted this request. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Bench noted that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>only 11 States<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> had filed their compliance affidavits so far. It directed the Principal Secretary of the Home Department of the concerned States and Union Territories, as well as the heads of the respective agencies, to be present before the Court on the next hearing date <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>if the affidavits are not filed by then<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">.
