Supreme Court Puts Discharge Above Acquittal\u201d"},"content":{"rendered":"\n<p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">In an important ruling, the Supreme Court of India has ruled that a person who is <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>discharged from a criminal case<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"> is in a <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>better position than someone who is acquitted after trial<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"text-align:center\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The judgment was delivered&nbsp; by Justices Dipankar Datta and K. V. Viswanathan.<\/span><\/span><\/p>\n \n \n \n <h3 dir=\"ltr\"><strong><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Case background:<\/span><\/span><\/strong><\/h3>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The case involved a former Air Force officer who was removed from service after a disciplinary inquiry. Earlier, the Air Force had filed criminal charges against him, but he was <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>discharged because there was no incriminating evidence<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">. Despite this, a departmental inquiry was conducted, and he was dismissed and denied service benefits.<\/span><\/span><\/p>\n \n \n \n <h3 dir=\"ltr\"><strong><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Court ruling:<\/span><\/span><\/strong><\/h3>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Justice Datta ruled that the dismissal was <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>void and unlawful<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">. He said:<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"margin-left:11pt\"><span style=\"font-size:14.5pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#0e0e0e\">&ldquo;once an accused has been discharged, he is entitled to avail of all benefits that are otherwise available to an acquitted person and cannot be placed in a less advantageous position.&rdquo;<\/span><\/span><\/span><\/p>\n \n \n \n <h3 dir=\"ltr\"><strong><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Air Force argument:<\/span><\/span><\/strong><\/h3>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Air Force argued that discharge is neither acquittal nor conviction, so administrative action could still be taken. However, the Court rejected this argument.<\/span><\/span><\/p>\n \n \n \n <h3 dir=\"ltr\"><strong><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Key distinction:<\/span><\/span><\/strong><\/h3>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Court clearly explained the difference between discharge and acquittal:<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\" style=\"margin-left:11pt\"><span style=\"font-size:14.5pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#0e0e0e\">&ldquo;Discharge is a pre-trial termination of proceedings for lack of evidence. As and when ordered, discharge signifies and reinforces the position that there is no material against the accused for him to stand trial. Whereas, acquittal is a post-trial outcome declaring the accused either innocent due to lack of credible material or on account of grant of the benefit of doubt. Insufficient evidence to even frame charges for standing trial would lead to a discharge while evidence presented not proving guilt leads to acquittal. In that sense, an accused discharged of a criminal offence stands on a better footing than an accused who is finally acquitted after a full-fledged trial.&rdquo;<\/span><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Court also relied on the case of Yuvraj Laxmilal Kanther v. State of Maharashtra to support this view.<\/span><\/span><\/p>\n \n \n \n <h3 dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Other rulings:<\/span><\/span><\/h3>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">At the same time, the Court noted that there are other rulings which say that <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>even an acquittal does not always stop departmental action<\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">, because criminal and departmental proceedings are separate. For example:<\/span><\/span><\/p>\n \n \n \n <ul>\n \n <li dir=\"ltr\" style=\"list-style-type:disc\">\n \n <p dir=\"ltr\"><span style=\"font-size:14pt\">Airport Authority of India v. Pradip Kumar Banerjee<\/span><br \/>\n \n &nbsp;<\/p>\n \n <\/li>\n \n <li dir=\"ltr\" style=\"list-style-type:disc\">\n \n <p dir=\"ltr\"><span style=\"font-size:14pt\">State of MP v.
