Mehta held that the police action violated constitutional protections and fundamental Rights.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Incident:<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The lawyer and the ex\u00e2\u20ac\u2018serviceman had gone to a police station to file a complaint about damage to the ex\u00e2\u20ac\u2018serviceman&rsquo;s vehicle. The opposite party then filed a cross\u00e2\u20ac\u2018complaint, alleging that the petitioners had manhandled them.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The police invoked preventive measures against the petitioners. They were detained at the police station, allegedly stripped to their undergarments, and then taken handcuffed to the tahsildar&rsquo;s office. <\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The police said that a crowd of 15&ndash;20 people had gathered, and preventive steps were necessary, which is why the petitioners were detained. They denied the allegation of stripping but admitted that the petitioners were detained.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Court Findings:<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The bench noted that the petitioners were neither habitual offenders nor hardened criminals, and therefore the use of handcuffs was completely unjustified. The judges held that the police action violated constitutional rights and ignored Supreme Court guidelines on handcuffing. <\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif; font-size:14pt\">The bench Observed :<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><em>&ldquo;Judicial notice is taken of the fact that the police and the jail authorities are even now using handcuffs and other fetters indiscriminately and without any justification,&rdquo; <\/em><\/span><\/span><\/p>\n \n \n \n <p><span style=\"font-family:Georgia,serif; font-size:14pt\">The Bench further stated :<\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">&ldquo;It may not be out of context to remind that the motto of Maharashtra State Police is &ldquo;Sadrakshnaya Khalanighrahanaya&rdquo; (Sanskrit: &ldquo;To protect good and to punish evil&rdquo;), which needs to be respected,&rdquo; .<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>Compensation Order:<\/strong><\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The High Court held that the police had infringed the petitioners&rsquo; fundamental rights and ordered the State to compensate them.<\/span><\/span><\/p>\n \n \n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">The Court directed the State to pay \u00e2\u201a\u00b950,000 each to the petitioners <\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><strong>within eight weeks, <\/strong><\/span><\/span><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">with the amount to be deposited before the Court. <\/span><\/span><\/p>\n \n \n \n <hr \/>\n \n <p dir=\"ltr\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\">Case Details : <\/span><\/span><a href=\"https:\/\/drive.google.com\/file\/d\/1bCdquTLaG-xSPlTGkIjOmCnohMZFG88K\/view?usp=sharing\" style=\"text-decoration:none\"><span style=\"font-size:14pt\"><span style=\"font-family:Georgia,serif\"><span style=\"color:#1155cc\"><u>Adv Yogeshwar Madhukarrao Kawade &amp; Anr.
